This document constitutes a legally binding agreement between you (the "User," "you") and Seneca 24 S.L. ("Company," "we," "us") regarding your use of the AISHE software and associated services (the "AISHE System"). By installing or using the AISHE System, you agree to be bound by these Terms.
1. Nature of the AISHE System
1.1. A Tool for Self-Directed Use: The AISHE System is a sophisticated Applied AI software tool designed to assist users in the autonomous analysis and execution of trades. It is provided to you as a tool for your own self-directed use. AISHE is not a financial advisor, broker, or investment fund.
1.2. No Financial Advice: The Company does not provide investment advice. All outputs and trades generated by the AISHE System are the product of its algorithmic analysis and should not be construed as personalized financial advice.
1.3. User Responsibility: You are solely and exclusively responsible for all decisions, trades, and outcomes resulting from your use of the AISHE System.
2. License Grant
2.1. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the AISHE System on a single computer for your personal use, subject to your active subscription and compliance with these Terms.
2.2. Restrictions: You agree not to copy, modify, reverse-engineer, decompile, or distribute the software to any third party.
3. Subscription, Fees, and Payments
3.1. Subscription Model: Access to the AISHE System is provided on a subscription basis. You agree to pay the applicable fees as published on our official website.
3.2. No Refund Policy: Due to the provision of a 14-day, fully functional free trial period which allows for comprehensive evaluation prior to purchase, all subscription fees are non-refundable. You may cancel your subscription at any time to prevent future charges.
4. User Obligations
4.1. Technical Requirements: You are responsible for providing and maintaining the necessary hardware, software (e.g., MetaTrader 4/5), and internet connection required to run the AISHE System.
4.2. Brokerage Account: You are solely responsible for your trading account with a third-party broker of your choice. Your relationship with your broker is governed by a separate agreement.
4.3. Risk Management: You are solely responsible for setting and monitoring the risk management parameters within the AISHE client.
5. Acknowledgment of Risk & Disclaimer of Warranties
5.1. Acknowledgement of Trading Risks: You acknowledge and fully understand that trading in financial markets involves a significant risk of financial loss. Past performance is not indicative of future results.
5.2. DISCLAIMER OF WARRANTIES: THE AISHE SYSTEM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
5.3. NO GUARANTEE OF AVAILABILITY OR PERFORMANCE: We do not guarantee that the AISHE System will be uninterrupted or error-free. The system's availability is conditional and may be terminated, particularly if ongoing operational costs are not sustainable.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM THE USE OR INABILITY TO USE THE AISHE SYSTEM. The liability of the Company for intent, gross negligence, and damages resulting from injury to life, body, or health shall remain unaffected.
7. Intellectual Property
All rights, title, and interest in and to the AISHE System are and shall remain the exclusive property of Seneca 24 S.L.
8. General Provisions
8.1. Governing Law & Jurisdiction: This agreement shall be governed by the laws of Spain. The exclusive jurisdiction for any disputes shall be the courts of Girona, Spain.
8.2. Changes to Terms: We reserve the right to modify these Terms at any time. Your continued use of the AISHE System after such changes constitutes your acceptance of the new Terms.
